The Role of the Zoning Board of Appeals

The zoning board of appeals (ZBA) consists of five members and an alternate who are appointed by the board of trustees. The planning commission and the township board each have a representative that serves as a liaison to the ZBA. Members are appointed to three year terms.

The ZBA is a semi-judicial body which is established to hear and act on the following matters: appeals of an administrative decision, variances from the standards contained in the zoning ordinance, use variances, permits for temporary uses, buildings and structures and zoning ordinance interpretations.

The most common requests are variances from requirements contained in the zoning ordinance, such as setbacks. In order for a variance to be considered, the applicant must demonstrate the following conditions are met. These conditions are summarized below, the entire set of criteria are contained within the application form which is available from our publications download page.

  • An exceptional or extraordinary condition exists and compliance with township standards would render conformity unnecessarily burdensome.
  • The practical difficulty is unique to the site and different than other properties in the same zoning district or vicinity.
  • The situation shall not be self-created.
  • The request would provide substantial justice by preserving property rights similar to the majority of other properties in the same zoning district or vicinity.
  • The variance is the minimum necessary to grant relief from the practical difficulty.
  • The request complies with other state and federal laws.

Request: 1) A variance to Art. 18.1, Schedule of Regulations, to allow a front yard setbackof 16’6" on one side and 24’2" on the other side, where 40’ is required, for construction of additions.
2) A variance to Art. 18.1, Schedule of Regulations, Note T, to allow off-street parking of 17’2" where 25’ is required for construction of an attached garage.

  • The additions shall conform to the conditions outlined in M. Sarb’s memo of July 9, 2008.
  • Garage will have a side entrance.
  • A 17’2" setback will be allowed for the side of the garage.
